All images and writings by Frances A. Smokowski are protected by national and international copyright laws. Please respect the intent of these laws which enable the development of t Ms. Smokowski's vision, expressed through Chrysalis Studio. Reproduction and dissemination of these images is the exclusive right of the artist.

Contract Work and Subsequent Usage
New works may be created for commercial applications at any time. Such work can be handled as a commission, with terms negotiated in advance and copyrights remaining with the artist and usage licensed under contract.
However, "work for hire," where copyrights become the property of the commissioning party, may also be accepted given fair remuneration for the long term, exclusive and unlimited value of the image rights.
All work is done by hand with traditional materials in Chrysalis Studio. Translation of art into digital image files must be contracted separately and additionally from parties who are capable of the safe handling of originals.
A contract and deposit are required for work to begin. Payment in full is required for the delivery of the work. Payment plans are available.

Copyright Licensing
Existing works featured on the "chrysalisstudio.com" website are available for use in commercial and non-commercial applications at the discretion of the artist. Both limited use and exclusive rights contracts may be considered. Fees are negotiated on a case by case basis and are dependent on the specifics of the application and the nature of the art works under discussion. Under no circumstances does the artist license rights to individuals or causes whose missions and practices are not consistent with the artist's own values. Therefore a detailed project description is required in writing, as well as at least one meeting to discuss the project in person with the artist's travel expenses, if any, covered in addition to the fee for use. All licensing agreements presented to the Artist are reviewed by her legal counsel at her own expense.
Use of art to illustrate any subject other than a discussion of the work of Frances Smokowski or the programs and services of Chrysalis Studio is permitted ONLY with written permission of the artist in a licensing agreement and with fair remuneration.

Free Use: promotional applications
In some instances use of images without a fee may be granted to select individuals and/or groups providing beneficial services to the artist, herself, or to the community.
Non-Print reproductions, including slides and transparencies, are not available for sale. However, the artist provides quality digital files and other reproductions by personal arrangement, and without fee, to persons and establishments working to represent or promote her endeavors. Eligible parties include but are not strictly limited to:
- Dealers and galleries
- Exhibition Curators and/or museum professionals
- Critics and Authors involved with publications discussing the work
- Editors and Publishers
- Lecturers with special arrangements for non-commercial applications

Non-Print Reproductions: for educational applications
As long as appropriate credit is given to the artist and the web site address "chrysalisstudio.com" is presented while the artwork is on the screen, images by Frances Smokowski may be projected in a workshop or lecture without fee as follows:
- in a "power point" presentation
- in a slide talk, or
- through the use of an overhead projector
Images gleaned from existing reproductions or provided by special arrangement with the artist may only be used for the purpose of the lecture or workshop. They cannot be otherwise distributed or sold for profit.

Non-Print Reproductions: limited use on a website
Select individuals are permitted to use ONE image free of charge on a personal (non-commercial) web site with permission from the artist in writing and with the following stipulations.
- The image must be used exactly as designed, with no modification whatsoever, but of scale.
- The artist's copyrights must be included WITH the image in a by line thusly:
© F. A. Smokowski.
- A link to "chrysalisstudio.com" must be visible WITH the image. If the requested and approved image is not already available with the URL text as described, we will create one for use under the terms of agreement.
- The image used must be no larger than 400 pixels/ 3 inches in either dimension.
Restrictions
Frances Smokowski does NOT allow her art to be cropped, collaged, customized, appropriated, adapted, incorporated, photoshopped, or in anyway altered for use within another artist's work.
If there is any question of whether the use you have in mind is permitted, it is always best to ask. Simply send a description of your ideas along with your contact information, and you will receive a reply at the artist's earliest convenience.
